Abstract |
The demographic situation in Russia requires careful attention to human reproductive rights. This makes it necessary to carefully examine all the criminal attacks that threaten reproductive rights and their features. Therefore, it is urgent to criminalize certain violations of reproductive rights, which are characterized by the improper use of assisted reproductive technologies. The society is concerned about the inept use of methods for the treatment of certain diseases, the use of medicines that endanger the reproductive health of people. However, the criminal law nowhere explicitly refers to such an object of criminal legal protection as human reproductive rights, and there is no criminal legal classification of criminal attacks on it. Although we cannot say that criminal liability is not provided for individual violations of reproductive rights. However, in the current criminal legislation of Russia, they are not combined into a separate section or Chapter, which indicates that the allocation of these crimes to a separate classification group was not part of the concept that was the basis of the current criminal legislation. Some of the features of criminal encroachments on reproductive rights are considered in the proposed article. |
